1. SCOPE
These Software License Terms govern the use of LingPO Desk ("the Software"), provided by Stephan Antipin ("the Licensor").
2. PERMITTED USE
The Software may be installed and used free of charge for personal and commercial purposes.
Commercial use includes use in a business, profession, employment, or in connection with paid services provided to third parties.
Organizations may install and provide the Software internally for use by their employees and other persons acting on their behalf.
3. RESTRICTIONS
Unless permitted by applicable law or authorized in writing by the Licensor, the Software may not be:
- modified, adapted, or used to create derivative versions;
- distributed or made available to third parties outside the permitted internal use of an organization;
- published, sublicensed, rented, leased, or sold;
- distributed as part of another product or service;
- reverse engineered, decompiled, or disassembled;
- distributed with copyright or other proprietary notices removed or altered.
These restrictions do not limit any rights that cannot be excluded or restricted under applicable law.
4. OWNERSHIP
LingPO Desk is proprietary software and is licensed, not sold.
All rights in the Software that are not expressly granted by these License Terms remain with the Licensor.
The source code of LingPO Desk is not provided or licensed under these License Terms.
5. NAME AND BRANDING
These License Terms do not grant any right to use the name "LingPO Desk", its logo, or associated branding as the name, logo, or branding of another product or service.
The name and branding may be used to refer accurately to LingPO Desk, provided that such use does not suggest an official connection, authorization, or endorsement that does not exist.
6. THIRD-PARTY COMPONENTS
The Software may include third-party libraries, frameworks, or other components that are subject to separate license terms.
Those license terms apply to the respective third-party components. Nothing in these License Terms restricts rights granted under applicable third-party licenses.
7. UPDATES AND SUPPORT
These License Terms do not create an entitlement to updates, new versions, support, maintenance, or continued availability of the Software unless separately agreed.
8. WARRANTY AND LIABILITY
The Software is provided free of charge.
No guarantee is given that the Software will always be available, operate without errors, or be suitable for a particular purpose unless expressly stated otherwise.
Statutory warranty, liability, and other rights that cannot be excluded or restricted remain unaffected.
9. TERMINATION
The Licensor may terminate the rights granted under these License Terms in the event of a material breach, to the extent permitted by applicable law.
After termination, use of the Software must cease and copies must be removed unless continued possession or use is permitted by applicable law or another valid license.
10. GOVERNING LAW
These License Terms are governed by the laws of the Federal Republic of Germany.
Mandatory consumer protection provisions applicable in the country of the user's habitual residence remain unaffected.
11. LANGUAGE
These License Terms are provided in German and English.
Both versions are intended to have the same meaning. In the event of any discrepancy or difference in interpretation, the German version shall prevail.
